1. Acceptance of Terms

By accessing or using DialerWorks ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

DialerWorks is an AI-powered calling and workflow orchestration platform that enables organizations to automate outbound calling, lead qualification, and appointment booking using AI voice agents and configurable workflows.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation, including the TCPA, TSR, or state telemarketing laws
  • Make calls to numbers on the National Do Not Call Registry without prior express consent
  • Engage in harassment, spam, or abusive calling practices
  • Misrepresent your identity or the purpose of your calls
  • Transmit malicious code or interfere with the Service
  • Resell access to the Service without authorization

5. Compliance Responsibilities

You are solely responsible for ensuring that your use of the Service complies with all applicable federal, state, and local laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), state do-not-call regulations, and call recording consent laws. DialerWorks provides tools to assist with compliance (DNC list management, call logging) but does not guarantee legal compliance.

6. Data Ownership

You retain ownership of all data you upload to or create within the Service, including lead data, call recordings, transcripts, and workflow configurations. DialerWorks will not access, use, or share your data except as necessary to provide the Service or as described in our Privacy Policy.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for any downtime, delays, or service interruptions.

8. Payment Terms

Fees are billed in advance on a monthly or annual basis as agreed upon in your subscription. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

9. Limitation of Liability

To the maximum extent permitted by law, DialerWorks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of your use of the Service.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease, and you may request export of your data within 30 days. After 30 days, we may delete your data in accordance with our retention policies.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
